Welcome to Kanary Lab. By accessing our "Market Intelligence Engine" and related services, you agree to the following terms. This is a B2B service intended exclusively for beauty industry professionals, brand owners, and marketers.

1. Nature of Service: Market Intelligence

Kanary Lab is a data aggregation and strategic analysis tool. We use Artificial Intelligence to:

• Aggregate Public Data: We analyze publicly available consumer reviews from third-party platforms (e.g., Amazon, Sephora) to provide market insights.
• Generate Strategy: Our AI generates "Competitor Takedown Reports" and marketing suggestions based on this data.

Data Source Disclaimer: Kanary Lab indexes only publicly accessible data. We are not affiliated with, endorsed by, or sponsored by the platforms we analyze (e.g., Amazon, Sephora, TikTok).

2. AI Output & Strategic Disclaimer

Our services utilize Generative AI (LLMs) to produce strategic advice, SWOT analyses, and ad copy. By using these features, you acknowledge:

• No Guarantee of Results: The "Strategy Reports" are theoretical models based on data. We do not guarantee specific business outcomes (e.g., increased sales, market share).
• Ad Copy Responsibility: You are solely responsible for reviewing any AI-generated marketing copy for compliance with advertising laws (e.g., FTC guidelines) and truthfulness. Kanary Lab is not liable for false advertising claims arising from your use of our generated content.
• AI Hallucinations: While we strive for accuracy, AI may occasionally produce incorrect assertions about ingredients or competitor flaws. You should verify critical claims manually before commercial use.

3. Intellectual Property & Ownership

• Your Input: You retain rights to any proprietary product data or CSVs you upload explicitly.
• Generated Assets: You own the full commercial rights to the "Strategy Reports" and "Ad Copy" generated by your account. You may use them freely in your marketing and internal documents.
• Our Tech: The underlying analysis taxonomy, "Sensory Radar" algorithms, and "Biological Profile" logic remain the property of Kanary Lab.

4. Acceptable Use Policy

You agree NOT to use Kanary Lab to:

• Generate content that promotes hate speech, violence, or illegal acts.
• Reverse engineer our scraping technology or API.
• Systematically copy our database to build a competing intelligence product.

5. Limitation of Liability

To the maximum extent permitted by law, Kanary Lab shall not be liable for any indirect, incidental, or consequential damages, including but not limited to:

• Loss of profits or revenue.
• Legal disputes with competitors arising from your marketing campaigns.
• Decisions made based on our market analysis.

6. Subscriptions & Refunds

Paid subscriptions (Strategist/Empire tiers) are billed via our payment provider (Creem). You may cancel anytime. Refunds are processed according to our standard refund policy available at checkout.

7. Updates to Terms

We may update these terms as our intelligence capabilities evolve. Continued use of the service constitutes acceptance of the new terms.
